Please read these Terms and Conditions ("Terms") carefully before using the services offered by Endless Prospects ("we," "us," or "our") and accessing our website, landing pages, and any related systems, forms, automations, and communications tools (the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our Services, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Services.
You understand and agree that our Services are designed to help support marketing and appointment workflows (including follow-up communications and AI-assisted responses). You are responsible for how you use any outputs, campaigns, or messaging in your business, and you agree to use the Services in compliance with applicable laws, advertising rules, and platform policies.
2. Fees and Payment (If Applicable)
If any part of the Services involves fees (for example, a subscription, implementation, or other paid plan), you agree to pay all applicable fees and charges on time according to the pricing and billing terms presented at checkout or in your agreement.
Unless otherwise expressly stated in writing:
1.Fees are billed in advance and are non-refundable.
2.Failed payments may result in paused services, suspended access, or delayed delivery of implementations.
3.You are responsible for any taxes or third-party fees associated with your use of the Services.
3. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
1.Your marketing or campaigns will generate any specific number of leads, appointments, or sales.
2.The Services will be uninterrupted, error-free, or completely secure.
3.Any defects will be corrected on a specific timeline.
Any examples, projections, or performance references are illustrative only and are not promises of results.
4. Limitation of Liability
To the maximum extent permitted by applicable law, Endless Prospects will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, revenue, data, use, goodwill, or other intangible losses) arising out of or relating to your access to, use of, or inability to use the Services.
To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the one (1) month immediately preceding the event giving rise to the claim.
5. Indemnification
You agree to indemnify and hold harmless Endless Prospects, and its affiliates, officers, directors, employees, contractors, agents, and licensors, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
1.Your use (or misuse) of the Services
2.Your campaigns, content, ads, or communications sent using your systems
3.Your violation of any law, regulation, or third-party right
4.Your breach of these Terms

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules.
7. Termination
We may terminate or suspend your access to all or part of the Services at any time, with or without notice, if:
1.You breach these Terms
2.Your use creates risk or legal exposure for us or others
3.Your account shows suspected fraud or abuse
